1. Who we are and what EnterJamaica is

1.1 These Terms of Use ("Terms") govern access to and use of enterjamaica.org, related subdomains, mobile surfaces, checkout flows, APIs, and EnterJamaica-operated features (together, the "Platform"), operated under the brand EnterJamaica ("EnterJamaica", "we", "us", "our").

1.2 EnterJamaica is a private third-party digital travel and immigration-assistance platform. We help Jamaica-bound travellers to:

  • complete, validate, and electronically submit the Official Jamaica Immigration and Customs Declaration (C5 Form) through our paid digital workflow;
  • receive confirmation, account access, and support records;
  • optionally purchase and receive prepaid eSIM connectivity where offered at checkout.

1.3 EnterJamaica is not the Government of Jamaica, not Jamaica Customs, not the Passport, Immigration and Citizenship Agency, and not any port-of-entry authority. We provide a convenience and facilitation service only. Final admission, inspection, duties, and enforcement are decided by Jamaican immigration and customs officials at the port of entry.

1.4 The Platform may link to or surface tours, activities, airport transfers, car rentals, or additional eSIM plans operated by third parties (including companion travel brands). Unless checkout clearly states that EnterJamaica is the merchant of record, those services are governed by the partner's terms, refund rules, and privacy notices.

1.5 EnterJamaica is not a law firm, immigration adviser, insurer, or emergency service. Information on the Platform is general and is not professional legal, medical, financial, or safety advice.

2. Acceptance and changes

2.1 By accessing or using the Platform, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Platform.

2.2 Where the Electronic Transactions Act applies, electronic acceptance (including clicking "I agree", creating an account, paying fees, or continuing to use the Platform after notice) has the same effect as a written signature.

2.3 We may change these Terms. For material changes, we will give at least 30 days' notice by email to registered users (where we have an address) and/or a prominent on-site notice before the new effective date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Platform and close your account.

3. Eligibility and accounts

3.1 You must be 18 or older to create an account or purchase paid services. If you are under 18, a parent or legal guardian must consent and supervise use.

3.2 You are responsible for activity under your account, for keeping credentials and confirmation codes secure, and for accurate, complete, and truthful information in every C5 submission.

3.3 We may suspend or terminate accounts for breach of these Terms, suspected fraud, chargebacks, abuse, or risk to the Platform or third parties, with or without notice where reasonably required.

4. C5 Form processing

4.1 Our C5 service includes digital access, field validation, secure transmission, confirmation delivery, and support within the scope described at checkout.

4.2 You authorise EnterJamaica to process and transmit the information you provide for the purpose of completing your declaration through the channels we use to deliver the service. You remain responsible for the accuracy of your answers and for complying with official immigration and customs law.

4.3 No guarantee of entry. Submitting a C5 form through EnterJamaica does not guarantee admission to Jamaica, visa approval, duty treatment, or acceptance of your declaration. Authorities may require additional documents, re-submission, interview, or refusal at the port of entry.

4.4 Once a C5 submission has been successfully processed and delivered to the applicable official workflow, it is generally non-refundable except as stated in the Refund Policy or where non-waivable consumer rights apply.

5. eSIM and digital connectivity

5.1 Optional eSIM products are digital goods. You must verify device compatibility, coverage, and activation steps before purchase.

5.2 eSIM plans are generally non-refundable once an activation code or QR code has been generated and delivered, except for documented platform-side technical failure as described in the Refund Policy.

5.3 Coverage, speed, and availability depend on local networks and your device. EnterJamaica does not operate mobile networks.

6. Paid services, pricing, and payment

6.1 Fees are shown before checkout. The C5 processing fee and any optional add-ons are service fees for the Platform workflow described at purchase.

6.2 Payment is processed through designated processors (for example Stripe). We do not store full card details on our servers.

6.3 An order is accepted when you receive written confirmation (email or in-account confirmation). We may refuse or cancel an order for pricing error, suspected fraud, legal restriction, or service unavailability.

7. User responsibilities and prohibited conduct

You agree to:

  • submit only lawful, accurate, and authorised information;
  • not impersonate another person or misrepresent your identity, nationality, or travel status;
  • not use the Platform to evade customs, immigration, or tax obligations;
  • not scrape, reverse engineer, or overload the Platform;
  • not resell or commercially exploit Platform content without written consent.

You are responsible for passports, visas, health requirements, customs declarations beyond the C5 scope, and compliance with Jamaican and foreign law.

8. Intellectual property

8.1 Third-party marks, government forms, and partner content remain the property of their respective owners. EnterJamaica claims rights in its brand, software, layout, validation logic, and original material.

8.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal travel and declaration purposes in accordance with these Terms.

8.3 The Copyright Act and applicable fair dealing or licensing principles apply to reuse. Rights concerns: [email protected] (subject: Rights-Holder Complaint).

9. Disclaimers

9.1 The Platform is provided "as is" and "as available". To the fullest extent permitted by law, EnterJamaica disclaims warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement for third-party and user-supplied content.

9.2 We do not guarantee uninterrupted service, error-free submission, or compatibility of every device or network.

9.3 Travel, health, legal, and official information on the Platform is general information only. Verify with qualified professionals and primary government sources before acting.

10. Limitation of liability

10.1 To the fullest extent permitted by Jamaican law, EnterJamaica is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from use of the Platform.

10.2 Our aggregate liability for claims relating to the Platform (other than liability that cannot be excluded by law) is limited to the greater of (a) JMD 50,000 or (b) the fees you paid EnterJamaica for the specific service giving rise to the claim in the twelve (12) months before the claim.

10.3 These limits do not apply to death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.

10.4 Primary responsibility for immigration, customs, and network-operator decisions remains with the relevant authority or provider, except where EnterJamaica has independently caused loss through its own deliberate wrongdoing or negligence.

11. Indemnity

You agree to indemnify and hold harmless EnterJamaica and its operators from claims, losses, and reasonable costs (including legal fees) arising from inaccurate or unlawful information you submit, your breach of these Terms, or your unlawful use of the Platform, except to the extent caused by EnterJamaica's deliberate wrongdoing or negligence.

12. Consumer rights

Nothing in these Terms excludes non-waivable consumer rights under Jamaican law, including rights under the Consumer Protection Act where applicable. Refund eligibility is also governed by our Refund Policy. You may contact the Consumer Affairs Commission about consumer matters.

13. Third-party links and services

13.1 The Platform may link to government portals, payment processors, eSIM partners, and travel providers. We do not control and are not responsible for their content, terms, or privacy practices.

13.2 Your use of linked services is governed by their terms and policies.

14. Governing law and disputes

14.1 These Terms are governed by the laws of Jamaica.

14.2 The courts of Jamaica have non-exclusive jurisdiction, subject to mandatory consumer or constitutional provisions.

14.3 Before formal proceedings, the parties will attempt good-faith negotiation for 30 days after written notice to [email protected]. Either party may then refer the dispute to mediation through the Dispute Resolution Foundation (or successor). Arbitration under the Arbitration Act 2017 applies only by written agreement of the parties.

15. General

15.1 If any provision is invalid, the remainder stays in effect.

15.2 Failure to enforce a provision is not a waiver.

15.3 You may not assign your rights without our consent. We may assign our rights in connection with a reorganisation or sale of the Platform.
